Article 1 – Definitions

In these Terms and Conditions, the following terms have the following meanings:

  1. Reflection Period: the period within which the consumer can exercise the right of withdrawal.

  2. Consumer: the natural person who is not acting in the course of a profession or business and who enters into a distance agreement with the entrepreneur.

  3. Day: calendar day.

  4. Long-term Transaction: a distance agreement related to a series of products and/or services, with delivery and/or purchase obligations spread over time.

  5. Durable Medium: any device that enables the consumer or entrepreneur to store personal information in a way that future reference and unaltered reproduction are possible.

  6. Right of Withdrawal: the option for the consumer to withdraw from the distance agreement within the reflection period.

  7. Model Withdrawal Form: the form provided by the entrepreneur to be used if the consumer wants to exercise their right of withdrawal.

  8. Entrepreneur: the legal or natural person who offers products and/or services to consumers remotely.

  9. Distance Agreement: a contract concluded exclusively via distance communication within a system organized by the entrepreneur for that purpose.

  10. Means of Distance Communication: tools used to conclude a contract without consumer and entrepreneur being in the same location.

  11. General Terms and Conditions: the current terms of the entrepreneur.

Article 3 – Applicability

  1. These general terms apply to every offer from the entrepreneur and all agreements and orders between entrepreneur and consumer.

  2. The terms will be provided to the consumer before a distance agreement is concluded. If this is not possible, the consumer will be informed where the terms can be reviewed and that they will be sent free of charge upon request.

  3. If the agreement is concluded electronically, the terms will be made available electronically in a storable format.

  4. If specific product or service conditions apply in addition to these terms, the consumer may always invoke the applicable provision most favorable to them.

  5. If any provision is nullified or voided, the remaining provisions will remain in effect and the invalid one will be replaced in mutual consultation.

  6. Situations not covered by these terms shall be judged according to their spirit.

  7. Ambiguities in interpretation will also be resolved in line with the intent of these terms.


Article 4 – The Offer

  1. Offers with a limited duration or subject to conditions will be clearly stated.

  2. All offers are non-binding. The entrepreneur may modify or withdraw them.

  3. Product descriptions are complete and accurate, including truthful images. Errors do not bind the entrepreneur.

  4. All visual and descriptive content is indicative and cannot serve as a basis for claims.

  5. Colours may vary slightly from images shown.

  6. Each offer will clearly indicate:

    • Total price including taxes

    • Shipping costs

    • Contract formation steps

    • Whether right of withdrawal applies

    • Payment, delivery, and contract execution terms

    • Validity duration of the offer

    • Communication costs if they differ from regular base rates

    • If the agreement is archived and accessible

    • How the consumer can review and correct information

    • Available languages for the contract

    • Applicable codes of conduct and how to access them

    • Minimum duration for long-term transactions

    • Optional: available sizes, colours, materials


Article 5 – The Agreement

  1. The agreement is concluded when the consumer accepts the offer and meets the associated conditions.

  2. For electronic orders, the entrepreneur confirms receipt immediately. The consumer can cancel until confirmation is received.

  3. The entrepreneur ensures safe electronic communication and payment.

  4. The entrepreneur may verify payment ability and other relevant factors. If there are valid reasons to decline, they may refuse the order or attach conditions.

  5. Upon delivery, the entrepreneur provides:

    • Business address for complaints

    • Instructions on withdrawal or mention of exclusions

    • Warranty and after-sales details

    • Info already provided under Article 4.3

    • Terms for termination if the agreement lasts more than a year or is indefinite

  6. These apply to the first delivery of long-term contracts.

  7. All contracts are subject to product availability.


Article 6 – Right of Withdrawal

For Products:

  1. The consumer can cancel within 14 days after receiving the product, without giving reasons.

  2. The product must be handled with care. Only open or use it to the extent needed to decide on keeping it. If returning, it must be sent back in its original state and packaging with all accessories.

  3. The consumer must notify the entrepreneur within 14 days using the model form. Then, the product must be returned within 14 more days. Proof of return must be available.

  4. If no notice or return is made within the deadlines, the purchase is final.

For Services:
5. The consumer can cancel a service contract within 14 days from the date of agreement.
6. Instructions provided by the entrepreneur must be followed.


Article 7 – Costs in Case of Withdrawal

  1. The return shipping costs are at the consumer’s expense.

  2. Paid amounts will be refunded within 14 days of withdrawal, provided the return is received or proven.

  3. Damage due to careless handling may result in a deduction from the refund.

  4. If the entrepreneur failed to provide mandatory withdrawal information, the consumer is not liable for value reduction.


Article 8 – Exclusion of Withdrawal

  1. The right of withdrawal may be excluded if clearly stated before purchase.

  2. Exclusion applies to products:
    a. Made to consumer's specification
    b. Of personal nature
    c. Unsuitable for return due to their nature
    d. That perish quickly
    e. With price fluctuations outside entrepreneur’s control
    f. Newspapers/magazines
    g. Opened audio/video/software
    h. Unsealed hygiene items

  3. Exclusion also applies to services:
    a. Related to accommodation, transport, catering, or leisure at a specific time
    b. Where delivery started with consumer’s consent before reflection period ended
    c. Concerning bets or lotteries


Article 9 – Price

  1. Prices remain fixed during the validity period unless VAT changes apply.

  2. Variable prices may apply to products tied to market fluctuations.

  3. Price increases within 3 months are only allowed if legally mandated.

  4. After 3 months, increases are allowed if:
    a. Based on laws or
    b. The consumer can cancel the contract

  5. Prices include VAT.

  6. No responsibility is accepted for typographical or printing errors.


Article 10 – Conformity and Warranty

  1. Products/services must match the agreement, descriptions, and legal requirements.

  2. Any additional manufacturer/importer warranties do not affect legal rights.

  3. Faults must be reported within 4 weeks. Returns must be in original condition.

  4. Warranty period matches the manufacturer's. Suitability for individual use is not guaranteed.

  5. Warranty is void if:

    • The product was repaired/modified by the consumer or a third party

    • Misuse or improper treatment occurred

    • The issue results from official regulations


Article 11 – Delivery and Execution

  1. Orders will be handled with care.

  2. Delivery is to the address provided by the consumer.

  3. Orders are executed within 30 days unless a longer term is agreed.

    • Delays will be communicated within 30 days.

    • The consumer may cancel if delivery fails.

    • No compensation is granted for delay.

  4. Delivery times are indicative. No rights can be claimed.

  5. On cancellation, the refund will be issued within 14 days.

  6. If a product is unavailable, a replacement may be offered.

    • Replacements will be clearly communicated.

    • Returns of replacements are at the entrepreneur’s expense.

  7. Risk transfers to the consumer upon delivery, unless agreed otherwise.


Article 12 – Long-Term Contracts: Duration, Termination and Renewal

Termination

  1. Consumers can cancel indefinite contracts for regular deliveries at any time with a notice of one month.

  2. Fixed-term contracts can be cancelled at the end with a notice of one month.

  3. Termination must be possible as easily as the agreement was made.

Renewal
4. Fixed-term contracts cannot be renewed silently, except for newspaper/magazine subscriptions (max 3 months).
5. Contracts renewed for indefinite terms must allow cancellation at any time with a one-month notice.
6. Trial subscriptions end automatically unless explicitly extended.

Duration
7. Contracts longer than a year can be cancelled after one year with a one-month notice, unless this is unreasonable.


Article 13 – Payment

  1. Unless agreed otherwise, payment must be made within 7 days from the start of the reflection period.

  2. Consumers must correct any payment errors promptly.

  3. In case of default, the entrepreneur may charge reasonable, previously communicated costs.


Article 14 – Complaints Procedure

  1. Complaints are handled according to a clearly published procedure.

  2. Complaints must be submitted within 7 days after identifying an issue.

  3. Complaints are answered within 14 days. If more time is needed, an acknowledgment and timeline will be given.

  4. If not resolved, the dispute becomes subject to the dispute procedure.

  5. First, contact the entrepreneur. If unresolved, and the shop is a member of WebwinkelKeur, consumers may request mediation. If needed, a binding decision will be made by the disputes committee. Filing costs may apply.

  6. Complaints do not suspend obligations.

  7. If justified, the entrepreneur will replace or repair products free of charge.


Article 15 – Disputes

  1. These terms and any agreements are governed exclusively by Dutch law, even if the consumer resides abroad.

  2. The Vienna Convention (CISG) does not apply.


Article 16 – Additional or Deviating Provisions

Any additions or deviations from these terms must be in writing and accessible to the consumer in a durable format.
